TERMS AND CONDITIONS OF SERVICE

1. Introduction

Welcome to Tramatch, where people of faiths meet with the purpose of marriage within their faith, and/or where serious relationships take place with the intention of culminating in marriage, either by customary or legal means in accordance to the laws of the country you reside in. These Terms and Conditions of Service ("Terms") govern your use of the Tramatch website and services. These Terms and Conditions are available at www.tramatch.com.

2. About us

2.1 We are Tramatch provided to you by TRAMATCH LTD (“us”, “we” or “our”) our postal address is 49 Ivory Close, Tuffley, Gloucester GL4 0QY, United Kingdom.

3.2  If you have any questions or complaints about Tramatch, including any concerns about the content, please reach out to us using the contact details above. Alternatively, you can use the “contact us” section on our website: www.tramatch.com. We will ensure we do our best to reply and address your enquiries as soon as possible.

3.3. Please, feel free to contact us with any feedback and/or suggestions for improvements and/or new features you would wish to see implemented in Tramatch.

4. How we will strive to contact you

4.1 We will either contact you via the email which you used to create your account or via notifications within the mobile app you have installed in your phone.

4.2 If the email you have used to create the account has changed, you need to notify us of these changes at your earliest convenience, in order to have the most up-to-date means to contact you if necessary.

5. About these Terms and Conditions, its purpose and scope

5.1 Tramatch is a global online platform designed to facilitate meaningful relationships based on religious traditional marriage values, including both monogamous and polygamous arrangements. Please read our Terms and Conditions carefully before signing up to our services. By accessing or using our Tramatch website or mobile App in any way, you accept these Terms and Conditions and agree to comply with them and all applicable laws and regulations, and acknowledge that you are responsible for compliance with any local laws that apply to you. If you do not agree with our Terms and Conditions you must not use our services in any way.

5.2 Tramatch is constantly evolving and we may make changes to our Terms and Conditions. Our Terms and Conditions will always be available on our website. You might want to check them regularly to see about any changes that could have taken place. When important changes have taken place we will take responsibility to notify you via notifications in App or via email.

5.3 If you do not agree with the changes that have taken place, you can get in touch with you and we will close your account as specified in clause 8 and its subclauses.

5.4 If you continue to use Tramatch in any of its formats, it means that you have agreed to follow the changes int the Terms and Conditions. If you do not agree with them, do not use Tramatch and notify us, so we can close your account following the procedure aforementioned.

6. Of the marriage practices mentioned in Tramatch

6.1 Tramatch allows users to express their relationship preferences during the registration process, this includes specifying the type of relationship they are seeking, in accordance with the platform’s mission of supporting traditional marriage values.

6.2 Tramatch supports individuals interested in both monogamous and polygamous marriages, reflecting diverse cultural and religious practices around the world. We acknowledge that legal frameworks around marriage vary by jurisdiction:

6.3 Legal Compliance: Users are responsible for understanding and complying with the marriage laws applicable in the jurisdiction they reside in. Tramatch does not condone illegal activity and requires all users to act within the bounds of their local and customary laws.

6.4 Informed Consent: All parties entering into a marriage arrangement of any kind that has been somehow facilitated by Tramatch must do so with full, informed consent, free from coercion or duress. Users must ensure that all marriage practices are consensual and legally permissible accordingly to the local and customary laws within the jurisdiction they reside on.

7. Eligibility to use Tramatch

7.1 Our goal is to create a respectful and safe environment for individuals who share a commitment to the valuesspecified at Tramatch. Tramatch is a platform which is intended for individuals who are seeking to enter into marriage, either of a monogamous or polygamous nature, based on religious, traditional and customary values that align with local laws in accordance to the place where you reside. By registering, you confirm that your intent to use Tramatch aligns with this purpose.

If you decide to use Tramatch, you must meet the following criteria:

7.2  You must be at least 18 years old which you confirm with Tramatch when you provide your date of birth when registering with us to create an account to use our services.

7.3  You must not be prohibited from using Tramatch by the laws of the country where you reside in or by us previously or any laws that apply when using Tramatch.

7.4  You have never been convicted of terrorism, a sexually related criminal offence, a hate or violent crime.

7.5  You must ensure that your device complies with the minimum technical standard with compatibility specifications to enable you download and use the appropriate version from the App Store or Play Store in accordance with your device. We are therefore not responsible nor liable for any failure to perform, delay in performance of any of our obligations to you which is caused by events outside our reasonable control, although we have taken reasonable care to ensure that the features and functionalities of Tramatch are of a reasonable and satisfactory standard.

7.6  As specified in clause 6.4 you are in charge of ensuring all arrangements have been made for you to be able to access Tramatch at will. We do not guarantee that Tramatch and its services will be available at all times or at any specific time.

7.7  You may only access Tramatch for personal use and non-commercial use.

8. Community Guidelines

8.1 As a member of Tramatch, we want you to help us maintain a safe and respectful environment. When creating an account at Tramach you acknowledge and accept to abide by adhering to the following set of rules:

8.2 Of your behaviour towards others:

8.2.1 you will use the platform for the intended purpose of marriage and therefore, you will not use an image which does not reflect a true likeness of yourself.

8.1.2 You will always provide us with up-to-date information and will keep it updated.

8.1.3 You will not act dishonestly, unprofessionally, including inappropriate, inaccurate or questionable content, which includes but it’s not limited to third party links to accounts outside Tramatch that do not align with the intended purpose of our application.

8.1.4 You will not create an account for anyone else other than yourself.

8.1.5 You will not misrepresent your identity, including but not limited to the use of a pseudonym or third party account.

8.1.6 You will not attempt to use another member’s account.

8.1.7 You will not scrape or copy profiles and information through any means which include but are not limited to browser plug-ins; add-ons or manual work. 

8.1.8 You will not harass, abuse and/or harm another person

8.1.9 You will not share or disclose information that you do not have the right to share

8.2 You will not send spam or unrequited communications to other members of the community.

8.2.1 You are responsible for your interactions with other members in its entirety, when using Tramatch and when meeting people via Tramatch either in person or indirectly. Always use your best judgement and make the appropriate safety precuations when communicating with other members in the Tramatch community. Always protect your personal information and never give away details such as your bank account details or credit card details.

8.2.2 Always report all suspicious and offensive behaviour you are subjected to or that you witness from another member of the Tramatch community. Also ensure you contact us regarding any concerns about member’s and their content if it breaks our community guidelines as specified in point 7.5.2 using our email office@tramatch.com or the “contact us” button in our website.

9.3 Of your behaviour towards Tramatch and its intellectual property:

9.3.1 You will not interfere nor disrupt Tramatch or any of its servers or networks in any form or shape with might include but not be limited to transmitting worms, viruses, malware, spyware and/or any other code of a destructive or malicious nature, which could otherwise alter and/or interfere with Tramatch its content or code.

9.3.2 You will not attempt to decipher, decompile, disassemble or reverse engineer the software used to operate Tramatch.

9.3.3 You will not use any content in any manner to infringe our rights or the rights of a third party.

9.3.4 You will not use the content in any way that might violate any applicable law or regulation or breach the terms and conditions outlined herein.

9.3.5 You will not encourage or enable any other individual to breach any of our community rules.

9.3.6 You will not act in an unlawful, libellous, abusive, obscene, discriminatory or otherwise questionable manner.

9.3.7 you will not share any financial information, for example, your bank account details, PayPal or Credit card information.

9.4 Of the content you publish in Tramatch:

9.4.1 You will not use any content in any manner that sexualises, abuses, exploits or endangers children, real or fictional (e.g. anime, media, text, illustrations or digital images). This includes but it is not limited to any visual depictions or discussions of sexually explicit conduct involving a child. For the purpose of these terms, a child is anyone under the age of 18 years of age.

9.4.2 The content you post will not promote discrimination, exploitation, terrorism, racism, bestiality, bigotry, hatred or physical harm of any kind against any group, individual or animal.

9.4.3 The content you post will not contain nor add a link to any content that is offensive, obscene, pornographic, indecent, malicious, threatening, abusive, depicting harm to humans and/or animals, defamatory, glorifying proscribed terror or violence or otherwise unlawful according to the laws of the country where you reside.

9.4.4 The content you post will not contain or otherwise link to contents that exploits people, children or otherwise your own self in a sexual, violent or otherwise unlawful manner.

9.4.5 The content you post will not contain or otherwise link to upload, store, produce, share or entice anyone to share nor produce child sexual abuse material, even if it is to express outrage and/or to raise awareness about this issue.

9.4.6 The content you post will not contain or otherwise publish any links that share content where there are software viruses, files or codes design to interrupt, destroy and/or limit the functionality of our site or that of any computer software or equipment. 

9.4.7 The content you post will not contain or otherwise aim to publish any illegal activities such as making or buying drugs or illegal weapons.

9.4.8 The content you post is your own original content and does not (and us by publishing it and using it will not) infringe or interfere with the rights of any third party.

9.4.9 The content you post will not contain or otherwise aim to publish content which contains videos, stills, photographs, audio or images of another person without their consent.

9.5 of Tramatch’s responsibility

9.5.1 We will monitor Tramatch within reason, but we are not obliged to monitor the access to use Tramatch or to review and edit any content or user content. However, we reserve the right without any obligation to monitor, moderate, edit, disable, access and/or to remove User Content which we deem to be in breach of these terms, which include our community guidelines. We have access to the use of a combination of manual and automated tools to flag inappropriate content which might be in breach of our guidelines and rules. We also reserve the right to consult and cooperate with law enforcement authorities to help them prosecute users who break the law.

9.5.2 If you believe that a user has published content which you consier infringes Tramatch or any third parties, including your own, and you believe it to be untrue, offensive, obscene, unlawful, misleading or otherwise fails to comply with these Terms and Conditions and our community guidelines, you may wish to notify us at office@tramatch.com or by directly using the “contact us” section on our platform.

9.5.3 When we receive a complain regarding the User Content, or Community Guidelines or our Terms and Conditions, we will review the user content in question and will make a decision.

9.5.4 We reserve the right to review the user content that is relevant to the issue in question while the investigation is being carried out if this has been flagged by either another member of the community or if it has been flagged up by our own team or the automation process, as an appeal to an account suspension, or as the result of a technical issue with Tramatch.  You agree that we may access and use the content under scrutiny for this purpose.

9.6 Of our right to restrict, suspend or end your access to Tramatch:

9.6.1 We reserve the right to restrict, suspend or close your account with immediate effect at any time if we believe that you are in breach of our Terms and Conditions, or are misusing Tramatch where you use terms in your descriptions / profile pictures that are offensive, obscene, pornographic, indecent, malicious, threatening, abusive, depicting harm to humans or animals, defamatory or otherwise unlawful.

9.6.2 we also reserve the right to restrict your access to use Tramatch including limiting the number of connections and restricting your ability to contact other members through our messaging service.

9.6.3 We also reserve the right to close your account by providing you notification via email for legitimate legal and/or business reasons.  

9.6.4 We can suspend the use and/or supply of Tramatch and any of its products to deal with technical problems, or to make changes and updates that reflect the requirements of the law. In case this takes place we will contact you via either email or notification via the app, unless we are facing an emergency or the issue at hand is urgent.

 

10. Closing your account

10.1 You can close your account at any time by emailing us at office@tramatch.com or by following the instructions in our platform to delete your account.

10.2 When you close the Tramatch account, your access to Tramatch will cease. You will lose all the matches, swipes, messages and any other information that you might have stored in our platform.

10.3 Upon request we will aim to provide you with a copy if your content within 30 days and only in a digital format. If no further requests are made, we will proceed to delete all the content stored in your account at Tramatch (unless we are requested by law to retain such details). 

10.4 We will retain user details and will be archived after 2 years in a non-active databse in accordance with our Privacy Policy.

11. Legality

11.1. each and everyone of these clauses in our Terms and Conditions operate separately. If any court of relevant authority decided that any of them (as a whole or partially) are unlawful, the remaining clauses (of part of them) will remain in full force and effect.

11.2 these Terms and Conditions are personal to you. You may only transfer your rights or obligations to someone else in writing.

11.3 we may transfer your rights and obligations in these Terms and Conditions to another organisation, but if this was the case, we will always communicate this in writing.

11.4 in the even of us transferring these Terms and Conditions to another organisation we will always ensure that the transfer will not affect your rights under the same.

11.5 if under the probability you have violated our Terms and Conditions and we do not insist and/or we delay in taking steps against you in this respect, it does not mean we will not take further steps or that you do not have to do as requested by Tramatch at a later date.

11.6 Subject to the following sentence, the English courts shall have exclusive jurisdiction to determine the interpretation and application of these Terms and Conditions is any dispute arises. However, if you are a resident of Northern Ireland, Scotland of the European Union, you may also bring proceedings in the courts of the country in which you reside in.

11.7 Arbitration: In the event of a dispute, users agree to first attempt to resolve the issue through informal negotiation. If a resolution cannot be reached, the dispute shall be resolved through binding arbitration, in accordance with the arbitration laws of the governing jurisdiction.

12. Indemnification

12.1 You agree to indemnify and hold Tramatch and its parties, its affiliates, officers, directors, employees, agents, and representatives harmless from any claims, damages (actual and consequential), liabilities, losses, and expenses (including reasonable legal fees) arising from  or in any way related to any claims relating to (a) your use of the Service (including any actions taken by a third party using your account) and (b) your violation of these Terms and Conditions.

13. Data Protection and Privacy

13.1 Tramatch is committed to protecting your privacy and personal data. Our use of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using Tramatch, you consent to the collection, use, and sharing of your data as described in the Privacy Policy.

14. Limitation of Liability

14.1 To the fullest extent permitted by law, Tramatch shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from:

14.2        Your access to or use of or inability to access or use the platform;

14.3        Any conduct or content of any third party on the platform, including without limitation, any defamatory, offensive, or illegal conduct of other users or third parties;

14.4        Any unauthorized access, use, or alteration of your transmissions or content.

15. Severability

15.1 If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect. The invalid or unenforceable provision will be interpreted to reflect the original intent of the parties, and the remaining provisions will remain binding and enforceable.

16. Entire Agreement

16.1 These Terms, together with the Privacy Policy and any other legal notices published by Tramatch, constitute the entire agreement between you and Tramatch regarding your use of the platform. They supersede any prior agreements, whether oral or written, between you and Tramatch regarding your use of the platform.
